1. Agreement to These Terms
These Terms of Use ("Terms") are a binding agreement between you and TopAhead Technology Solutions, Inc, a Florida profit corporation (Sunbiz Document Number P11000067250), doing business as FindRetireHome ("FindRetireHome," "FRH," "Company," "we," "us," or "our"), governing your access to and use of https://findretirehome.com and related consumer-facing pages, tools, forms, and communications (the "Services").
By accessing or using the Services, submitting a form, or requesting a call/text/email, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
Partner portal / communities: If you access partner tools or sign a Community Partner Agreement, that agreement controls the commercial relationship. These consumer Terms still apply to general Site use unless the Partner Agreement expressly supersedes a provision.

3. Eligibility
You must be at least 18 years old (or the age of majority where you live) to submit lead forms or request advisor contact. By using the Services, you represent that you meet this requirement and that information you provide is accurate to the best of your knowledge.
4. Nature of the Services. Informational Listings and Referral Connections
FindRetireHome provides:
- Informational listings and directory-style information about senior living options
- Advisor-assisted matching / shortlists and referral connections to communities
- Educational content about senior living topics
We are not:
- A medical provider, care manager, attorney, or financial advisor
- An owner or operator of the listed communities (unless expressly stated for a specific property. Default: we are not)
- A guarantee of admission, pricing, availability, or clinical appropriateness
No medical, legal, or financial advice. Content on the Services is for general informational purposes only. Always consult qualified professionals and verify all details directly with the community and your advisors before making housing or care decisions.
5. Verify with the Community; Data May Lag
Facility attributes, ratings, license status, staffing, pricing ranges, and availability may come from community submissions, public sources (including AHCA, CMS, or similar), or third parties.
- Public / regulatory data may lag or contain errors
- You must verify license status, services, fees, care capabilities, and contract terms directly with the community before touring, depositing, or signing
- We do not warrant completeness or accuracy of listing data
6. Families Free; Partner Fees (High-Level Disclosure)
How FindRetireHome is paid
FindRetireHome is free for families. You do not pay us to search, request pricing, schedule a tour, or speak with an advisor. Partner communities may pay FindRetireHome a marketing subscription and/or a private-pay move-in success fee. Those partner fees are not added to your quoted monthly rate. Advisor shortlists often include partner communities. Best Match is based on fit, not on who pays us more. You can contact or tour any community, including ones that do not pay us, and you are not obligated to use our referrals. Read the full disclosure.
Using FindRetireHome is free for families and consumers. You do not pay FindRetireHome a referral fee.
Communities / partners may pay FindRetireHome under a signed Community Partner Agreement, which may include one or both of:

Important for families:
- Partner fees are paid by the community, not by you to FRH
- Partner fees must not increase the family's quoted or contracted monthly rate under our Partner Agreement covenants
- Optional Featured / Promoted placements (if offered) are labeled; we do not sell organic / advisor / "Best Match" rank ("no pay-to-rank")

Subscription (Track A) is a marketing fee to partners and is separate from any private-pay placement success fee (Track B). Neither track is a charge to families for browsing or getting help.
7. Accounts, Forms, and Communications
You agree to provide accurate contact information. If you consent to phone, SMS, or email contact, our advisors (operating for TopAhead / FindRetireHome) may contact you as described in the consent language on the form and our Privacy Policy. You may opt out of SMS (STOP) and marketing email (unsubscribe) as provided.
7A. SMS / Text Messaging Terms
Program name: FindRetireHome (operated by TopAhead Technology Solutions, Inc). What we text: listing-claim links and account notices that a senior living community administrator requested on a call, by email, or in the partner portal, and advisor follow-ups that a family asked for on a form. Message frequency may vary. Message and data rates may apply. Reply STOP to opt out at any time; you will receive one confirmation and no further messages. Reply HELP for help, or contact [email protected] or +1 305-390-4707. Carriers are not liable for delayed or undelivered messages. Consent to receive texts is not a condition of any purchase or of using the Services. Your consent and SMS opt-in status are handled as described in our Privacy Policy, Section 9.
8. Acceptable Use
You agree not to:
- Submit false, misleading, or fraudulent inquiries or impersonate others
- Harvest, scrape, or bulk-extract listing data, contact info, or Site content without our prior written consent (except ordinary browser use or public search engines respecting robots.txt)
- Interfere with or disrupt the Services, attempt unauthorized access, or probe vulnerabilities except with written authorization
- Use the Services to spam, harass, or send unlawful communications
- Reverse engineer non-public aspects of the Services except where law prohibits that restriction
- Use the Services for any unlawful purpose, including unlawful referral or kickback schemes
- Misrepresent your relationship with FindRetireHome
We may suspend or terminate access for violations, suspected fraud, or risk to others.
9. Intellectual Property
The Services, including text, graphics, logos, layout, software, and compilation of listings presented by FRH, are owned by FindRetireHome or its licensors and protected by intellectual property laws. Community names, logos, and facility photos may be trademarks or content of those communities.
We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial senior-living research. You may not copy, modify, distribute, sell, or create derivative works from Site content except as allowed by these Terms or mandatory law.
"FindRetireHome," related marks, and the Site design are trademarks of TopAhead Technology Solutions, Inc or its licensors. Third-party marks are the property of their owners.
10. User Content
If you submit reviews, comments, messages, or other content ("User Content"), you grant FindRetireHome a worldwide, non-exclusive, royalty-free license to use, host, reproduce, and display that User Content as needed to operate and improve the Services and to make introductions you request. You represent that you have the rights to submit User Content and that it does not violate law or third-party rights. We may remove User Content at our discretion.
11. Third-Party Services and Links
The Services may link to third-party sites (communities, maps, regulators). We are not responsible for third-party content, policies, or practices. Your dealings with communities are solely between you and them.
12. Disclaimers
THE SERVICES AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that: (a) listings are accurate, complete, or current; (b) the Services will be uninterrupted or error-free; (c) any community is suitable for a particular person's clinical or personal needs; or (d) advisor shortlists include all possible options.
Some jurisdictions do not allow certain disclaimers; in those cases, disclaimers apply to the fullest extent permitted.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOPAHEAD TECHNOLOGY SOLUTIONS, INC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES OR THESE TERMS, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100) OR THE AMOUNT YOU PAID US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (IF ANY), WHICHEVER IS GREATER. BECAUSE FAMILIES ORDINARILY PAY $0 TO FRH, THE $100 CAP TYPICALLY APPLIES.
Nothing in these Terms limits liability that cannot be limited under applicable law (including certain liability for gross negligence or intentional misconduct where such limitation is prohibited).
14. Indemnification
You agree to defend, indemnify, and hold harmless TopAhead Technology Solutions, Inc and its officers, directors, employees, and agents from and against claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your misuse of the Services; (b) your User Content; (c) your violation of these Terms or law; or (d) inaccurate information you submit that causes harm to a third party.
15. Dispute Resolution; Governing Law; Venue
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules, except that the Federal Arbitration Act governs arbitration provisions if arbitration applies.
Informal resolution first. Before filing a claim, you agree to contact us at [email protected] or +1 305-390-4707 and attempt to resolve the dispute informally for 30 days.
Arbitration / small claims. Except for (i) claims that qualify for small-claims court and (ii) claims for injunctive or other equitable relief to protect IP or unauthorized access, any dispute arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration administered by AAA under its Consumer Arbitration Rules. You and we waive any right to a jury trial and to participate in a class action or class arbitration to the fullest extent permitted by law. Venue for any court proceedings permitted under these Terms (including to compel arbitration or confirm an award) is the state or federal courts in Broward County, Florida, and you consent to personal jurisdiction there.
If the class-action waiver is found unenforceable as to a particular claim, that claim may proceed in court in Broward County, Florida, and the remainder of this section continues in effect. If arbitration is found unenforceable in full, disputes will be litigated exclusively in Broward County, Florida.
16. Termination
You may stop using the Services at any time. We may suspend or terminate access immediately if you violate these Terms, create risk or legal exposure, or if we discontinue the Services. Provisions that by nature should survive (including IP, disclaimers, liability limits, indemnity, and dispute resolution) survive termination.
17. Changes to These Terms
We may modify these Terms by posting an updated version with a new Last Revised date. Material changes will be posted on the Site; where required by law, we will provide additional notice. Continued use after the effective date constitutes acceptance to the extent permitted by law. If you do not agree, stop using the Services.
18. Miscellaneous
These Terms, together with the Privacy Policy and any consent you provide on forms, are the entire agreement between you and us regarding the Services (except Partner Agreements for partners). If any provision is unenforceable, the remainder remains in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Headings are for convenience only. Notices to you may be provided via Site posting, email, SMS, or phone.
19. Accessibility
FindRetireHome aims to improve accessibility of the consumer Site. Our target standard is WCAG 2.1 Level AA (aspirational pending audit). This section does not modify the disclaimers or liability limits in these Terms.
