Florida's New Memory Care Services License (2026)
Florida created a new Memory Care Services specialty license in 2026. Families touring dementia programs should treat it as a diligence question now, even though AHCA is still writing the rules.
What the 2026 law actually does
CS/CS/SB 1404 became Chapter 2026-102. The governor approved it on May 22, 2026. It requires an assisted living facility that serves memory care residents, or holds itself out as providing memory care, to obtain a Memory Care Services license in addition to the Standard ALF license.
AHCA must adopt minimum standards by June 1, 2027. Those rules will cover admission, staffing, training, safety, physical plant, and advertising. Facilities licensed after the rules take effect must hold the specialty license to offer or market memory care. Facilities licensed before that date have six months after the rules take effect to obtain it. The specialty license renews with the Standard license.
This is not the same as today's ECC, LNS, or LMH endorsements. Do not assume a "memory care neighborhood" already holds a separate AHCA memory care license. Ask what the community holds today, and what its plan is after rulemaking.
What does not change for families
You still need a care-level fit, a written all-in price, and an inspection review. A future license does not erase a recent Class 1 or Class 2 finding. Medicare still does not pay ongoing memory care. Medicaid, when it helps, still follows the SMMC LTC rules and still does not pay room and board in an ALF.

Ask three questions: do you serve residents with Alzheimer's or related dementia today, is the neighborhood secured at night, and how will you comply once AHCA issues Memory Care Services rules?
