After a Marchman Act Stay: Assisted Living in Florida
A Florida treatment program says the Marchman Act clock is ending, and families search Marchman Act assisted living the same afternoon. The next address is a stability and paperwork problem before it is an apartment problem. This page is discharge planning only. It is not legal advice, not medical advice, and not a guide to starting a petition.
Finish treatment first when it is still treatment
If the person is still in withdrawal, still needs 24-hour medical detox, or is still a danger to themselves or others, stay in the licensed treatment setting or the hospital. An ALF is a community home. It is not a Marchman Act receiving facility and it is not a sober-living house.
When the team says a less restrictive setting is next, name the real driver. Repeated falls after drinking, missed heart or diabetes pills, and nights alone in a house with stairs are assisted living questions. A court order that only bought time for detox is not a care-level diagnosis. If a Baker Act hold or a long-standing serious mental illness is also in the story, read those pages the same day. Delirium after a UTI or a medication change can look like a substance crisis and then clear. Read our UTI delirium guide before you sign a long lease on day two.
AHCA Form 1823 still has to come from an MD, DO, PA, or APRN. Ask the treating clinician to start it before discharge. A Marchman Act packet is not a substitute for that form.
The tour is nights, meds, and who can sign
Ask who watches for a return of drinking or drug use, who administers time-sensitive pills, and what happens if the person leaves campus. A standard ALF generally cannot run a locked treatment program. Limited Mental Health applies only when the person meets Florida's mental health resident definition. Do not filter the whole state to LMH because the court file mentioned alcohol.
A residency contract needs a signer with authority. If capacity is in doubt, stop and get counsel. Our power-of-attorney and guardianship guides belong on the same day as the tour. Medicare does not convert a substance-use admission into an ALF month. Map private pay, long-term care insurance, VA benefits, or a later Medicaid path against an all-in quote.
Shortlist a home, not a program brochure
Open the nearest city hub. Compare two ALFs that can take today's mobility and medication picture, plus a skilled option if withdrawal, wounds, or 24-hour nursing is still the driver. Read medication and elopement findings. Then take the free care assessment so a licensed advisor can send the same discharge picture only to communities that will write a night plan, at no cost to the family.
Common questions
- Can someone go to a Florida ALF after a Marchman Act stay?
- Sometimes, once the treatment team says the person is medically stable for a community setting and the ALF administrator agrees. A Marchman Act stay is court-ordered substance-use care. It is not an automatic assisted living admission. Active withdrawal, 24-hour medical detox, or a person who is still a danger to themselves or others still belongs in treatment or a hospital.
- Is a Marchman Act discharge the same as a Baker Act discharge?
- No. The Baker Act is Florida's mental-health examination law. The Marchman Act is Florida's substance-use assessment and treatment law. A parent can have both stories in the same year. Read the matching discharge page. Limited Mental Health is a narrower ALF license for statutory mental health residents. It is not a sober-living program and not automatic after detox.
- Does Medicare pay for assisted living after a Marchman Act stay?
- No. Medicare may cover a qualifying hospital or skilled stay when medical criteria are met. It does not pay ongoing assisted living room and board. Sober living, residential treatment, and an ALF are three different products. Confirm who can sign the residency contract before you treat a model apartment as a yes.
