Private-Duty Nurses in Florida Assisted Living
Adult children search private duty nurse assisted living after a hospital says the parent can leave, but only with "someone medical in the room." A Florida ALF can often host that extra person. It cannot use the extra person to ignore the license. This page is not legal advice.
Third-party care is allowed. The admission rule still wins.
Section 429.255, Florida Statutes, lets facility staff and the family contract with a licensed third party when the resident remains appropriate for the setting. The assisted living rule chapter also says a resident may independently arrange a home-health agency or private nurse, and the community must allow those visits when placement is still appropriate. The third party has to coordinate with the building. A house rule that bans every outside aide is the exception you should get in writing, not the assumption.
Ask who badges the nurse in, where supplies are stored, and whether overnight private duty is allowed in a shared room. Ask what happens if the private nurse calls off. Facility staff still have to observe, document, and tell the physician. They do not become a hospital team because you hired an RN for the day shift.
Private duty does not convert a standard ALF into a nursing home. If the person needs 24-hour licensed nursing, staff-assisted tube feeding, or is bedridden beyond the short clock (unless hospice applies), start on the nursing home hub. You will owe ALF rent and care-level fees, plus the private-duty hourly or shift rate, plus any Medicare or private home-health copays that do not apply. City-hub starting prices are a floor. Awake overnight private duty can exceed the community month on its own. Compare that stack to a skilled nursing shortlist before you sign both contracts.

Common questions
- Can we hire a private-duty nurse or aide inside a Florida ALF?
- Usually yes, when the resident still meets admission and continued-residency rules and follows the community's third-party policy. Florida law lets a resident or legal representative contract with a licensed third party. The extra nurse does not rewrite what the ALF license can keep.
- Does a private-duty nurse let someone stay if the ALF would otherwise discharge them?
- Not by itself. The administrator still decides whether placement is appropriate. Twenty-four-hour licensed nursing, a feeding tube that staff must run, or a bedridden stay beyond the short ALF clock still fail a standard admission. Hospice can change some of those pictures.
- Is a private-duty nurse the same as Medicare home health?
- No. Private duty is usually a family-paid aide or nurse for set hours. Medicare home health is intermittent skilled visits when the person is homebound and a certified agency has an order. You can sometimes use both. Price them as separate bills on top of ALF rent.
